Credit card payments:  for immediate approval, orders may be placed using VISA, MasterCard, or American Express.

Payment terms:  unless otherwise agreed to in advance, terms are NET 30 DAYS FROM DATE OF INVOICE.  Rock West Composites (RWC) may require full or partial payment or payment guarantee in advance of shipment whenever, in its opinion, the financial condition of the buyer so warrants.

Service charges:  RWC reserves the right to assess a service charge of 1.5% per month on unpaid balance until paid.  Buyer shall be liable for all expenses, including attorney’s fees, related to the collection of past due accounts.

Credit approval:  all orders are subject to credit approval.

Past due accounts:  RWC reserves the right to withhold shipment of materials pending resolution of past due account balances.

Credit terms:  RWC reserves the right to revise credit terms based on credit history.

Pricing:  RWC prices and discounts are subject to change without notice and do not include any state or local taxes.  Buyer shall pay, in addition to the price of the goods, all applicable taxes and excises unless Buyer furnishes RWC with a valid “Reseller Number” or copy of tax exemption certificates.  Prices are quoted and payable in US Dollars.  All orders are subject to applicable shipping, freight, taxes, and handling charges.

Shipments and Delivery:  all goods are sold FOB RWC shipping point.  Goods may be shipped in a single shipment or multiple shipments at RWC’s discretion.  RWC will attempt in good faith to meet estimated shipping dates but shall not be liable to Buyer for any loss or damages due to delay caused by RWC.

Returns:  Return requests must be made by Buyer within 30 days of date on invoice.  All returns must include an RMA # (Return Material Authorization) issued by RWC or the return shipment will be denied by RWC.  Goods must be shipped to RWC by Buyer within 7 days of issuance of RMA #.  Unless the product is defective or the return is a direct result of a RWC error, Buyer shall pay the cost of return shipping and is responsible for insuring the shipment against loss or damage.  Goods that are returned in new condition will be subject to a restocking fee of 15%.  Goods returned in new condition are eligible for a refund of the full item price minus shipping/handling, unless the product is defective or the return is a direct result of a RWC error.  Goods that are returned in used or damaged condition will not be eligible for refund.

Damaged shipments:  Shipments received by Buyer in a damaged condition must immediately be identified to Carrier.  All claims for damaged shipments must be filed with Carrier.

Cancellations:  orders may be cancelled without cancellation charges provided the order has not been initiated by RWC.

Claims:  all shipments should be checked immediately after arrival.  All claims, whether referring to errors in pricing, mis-shipments, or defective goods, must be called in or e-mailed to RWC within 7 calendar days.  All damaged goods and containers must be kept for inspection.

Limited Warranty:  RWC warrants that all goods shipped are free from defects in materials and workmanship.  RWC cannot foresee all conditions under which RWC products will be used and therefore cannot warrant or guarantee any performance results.  Buyers should always perform tests prior to using RWC products in any application.  Buyer waives any claim against RWC for direct, indirect, consequential, or exemplary damages including without limitation, damage which may incur as a result of Buyer’s use or misuse of the product or the product’s failure to perform to any expected performance level.
